Hair Testing

Role of the Medical Review Officer:

Medical Review Officers (MROs) play a critical role in workplace drug testing programs, ensuring that the process is carried out with the highest degree of fairness for both employers and employees. Their primary responsibilities involve reviewing and interpreting confirmed positive drug test results to determine if there is a legitimate medical explanation for the finding. By doing so, they act as an impartial gatekeeper to guard against wrongful accusations and preserve the integrity of the testing process.

One of the indispensable benefits that MROs offer in this capacity is the ability to overturn initial positive test results caused by legal prescription medications. Should an employee have a verified prescription that explains the presence of a certain substance in their system, the MRO can legitimately classify the test result as negative. This is where Safety Sensitive Letters (SSLs) come into play, serving as a critical liaison between healthcare providers, employees, and employers.

What are Safety Sensitive Letters?

Safety Sensitive Letters, also known as Fitness-for-Duty letters, are documents typically written by healthcare professionals to alert employers that an employee or a job applicant taking a legally prescribed medication may have some impairment that could affect their ability to safely perform certain job functions. The key goal of these letters is not to disclose private medical details but to ensure that the individual’s condition does not pose a risk in the workplace, particularly when it comes to safety-sensitive positions such as operating heavy machinery, driving commercial vehicles, or managing hazardous materials.

Addressing Safety Sensitive Letters: The Approach

When a healthcare provider prescribes medication that may cause drowsiness, slow reaction times, or other impacts that raise safety concerns, they must consider whether these side effects can compromise safety when the patient is at work. In these situations, the healthcare provider typically sends an SSL to the employer.

The Purpose

The letter’s primary purpose is to strike a responsible balance between the employee’s privacy rights and the employer’s need to maintain a safe working environment. It does not diagnose, but instead, informs on potential safety implications without disclosing the specific medical condition or medication.

The Audience

The audience for the SSL comprises employers, HR managers, and safety officers who have a vested interest in the safe operations within their organization. These recipients use the information to make informed decisions about an employee’s work situation and take appropriate measures to mitigate risks.

Addressing the Letter

SSLs should be written with care, respecting medical confidentiality. The address paragraph typically contains the recipient’s name and title, company name, and address to ensure it reaches the right hands immediately. The opening sentence should state the letter’s intent without divulging sensitive medical information.

The body of the letter outlines the existence of a condition related to the employee’s ability to safely perform job duties. It is recommended to provide guidance on work restrictions or modifications, if applicable, based on the general side effects of the prescription rather than specific medical details.

Follow-ups and Data Handling

The SSL generally advises the employer to follow up with the employee in question regarding their ability to perform safety-sensitive tasks and to keep the information in strict confidence. Employers must handle SSLs with the utmost care, in compliance with the Americans with Disabilities Act (ADA), the Health Insurance Portability and Accountability Act (HIPAA), and any other relevant privacy laws and regulations.

What does the Employer Do?

Once the employer receives a Safety Sensitive Letter, they request the employee goes to their prescribing physician or Occupational Physician to determine if the individual can perform safety sensitive duties on their current prescription.  In most cases, the prescription will be changed to one that will not interfere with their safety sensitive duties.
