Medical Review Officer (MRO)

The role of the Medical Review Officer is critical in the DOT drug testing process. An MRO is a licensed physician responsible for receiving and reviewing laboratory results generated by an employer’s drug testing program and evaluating those results within the proper medical context. The MRO ensures the process’s integrity by verifying positive, adulterated, substituted, or invalid drug test results. The MRO also manages the Non-Contact Positive and Safety Sensitive Letters. Non-contact positive is when the donor hasn’t returned messages left at least three times during a 24 hour period and Safety Sensitive letters are when a safety-sensitive employee has a legal prescription, so the drug result is negative, however, the MRO is concerned about the employees being able to safely perform their duties while on this prescription.   The situation can be resolved by sending the employee to their prescribing physician or an occupational physician.  Normally, the Safety Sensitive Letter  is resolved by changing the prescription.

FMCSA Clearinghouse

The FMCSA Clearinghouse is a secure online database that provides real-time information about commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders’ drug and alcohol program violations. The Clearinghouse is an invaluable tool for employers in the compliance process, making it easier to ensure drivers meet the DOT’s drug and alcohol use standards.  Employers must do the following in order to be compliant in the Clearinghouse FMCSA:

  • Employers must register in the FMCSA Clearinghouse.
  • Employers must have a FMCSA Clearinghouse Addendum to their Drug and Alcohol Testing Policy.
  • Employers must query each new hire in the FMCSA Drug and Alcohol Clearinghouse.
  • Employers must query each driver annually in the FMCSA Drug and Alcohol Clearinghouse.
  • Employers must report all positive alcohols to the FMCSA Clearinghouse.
  • Employers must report all collection site refusals to the FMCSA Clearinghouse.
  • Employers must report all known drug and alcohol use to the FMCSA Clearinghouse.
  • Employers must report all Return to Duty Test in the FMCSA Clearinghouse.
  • Employers must report all Completion of Follow-Up Testing in the FMCSA Clearinghouse.
