Important Notice for Fleet Managers, CDL Drivers, and Owner-Operators

Starting November 18, 2024, new federal regulations will significantly impact CDL holders with drug and alcohol program violations. Drivers flagged as “prohibited” in the FMCSA Drug and Alcohol Clearinghouse will have their commercial driving privileges suspended or denied by their state licensing authorities.

What Does This Mean for CDL Drivers?

Drivers with violations will be barred from performing safety-sensitive duties, including operating commercial motor vehicles (CMVs) under DOT regulations, until they successfully complete the return-to-duty process. Failing to meet FMCSA Clearinghouse requirements could result in losing, or being unable to obtain, a CDL or CLP.

New Requirements for SDLAs

State Driver Licensing Agencies (SDLAs) are now required to check the FMCSA Clearinghouse before completing specific CDL or CLP-related actions, such as:

  • Issuing, renewing, upgrading, or transferring a CDL
  • Issuing, renewing, or upgrading a CLP

Drivers with unresolved violations in the Clearinghouse will be unable to proceed with these licensing actions, making it impossible for them to resume their professional driving duties.
