What is the FMCSA Clearinghouse?

The FMCSA Clearinghouse is a centralized, secure online database. It provides FMCSA employers, the FMCSA, State Driver Licensing Agencies, and law enforcement with instant access to information on drug and alcohol program violations by holders of commercial driver’s licenses (CDL) and commercial learner’s permits (CLP).

The main purpose of the Clearinghouse is to improve road safety. It ensures drivers who have violations complete the required return-to-duty process before they can operate a commercial motor vehicle (CMV) again. Previously, tracking a driver’s history across multiple employers was challenging. This database closes that gap, preventing drivers from hiding past violations simply by switching jobs.

An Employer’s Core Responsibilities

If you employ drivers with a CDL or CLP who operate CMVs, you must comply with FMCSA Clearinghouse regulations. Your fundamental duties include registering with the Clearinghouse, running queries on new and existing employees, and reporting all drug and alcohol program violations.

Registration and Management

The first step is to register your company in the Clearinghouse. This is mandatory before you can perform queries or report violations. During this process, you’ll designate a Clearinghouse administrator to manage your company’s account.

Running Queries

A query is an electronic check within the Clearinghouse to determine if an employee or candidate has any unresolved drug or alcohol violations. There are two primary types:

  • Limited Queries: You are required to run a limited query on all your current CDL drivers at least once per year. This check reveals if any information exists in the driver’s Clearinghouse record. If it does, you must conduct a full query within 24 hours. A general consent form is needed from the driver for limited queries.
  • Full Queries (Pre-Employment): A full query must be conducted before you hire a CDL driver for a safety-sensitive position. This provides detailed information about any violations on the driver’s record. The driver must give specific electronic consent through the Clearinghouse before you can view this information.

Reporting Violations

Employers have a legal duty to report certain drug and alcohol violations to the Clearinghouse within three business days. These include:

  • An alcohol test result showing a concentration of 0.04 or higher.
  • A driver’s refusal to take a required drug or alcohol test.
  • A report based on actual knowledge of a violation.
  • A negative return-to-duty test result.
  • The completion of all return to duty andfollow-up testing as directed by a Substance Abuse Professional (SAP).

Prompt and accurate reporting is essential for compliance and maintaining the reliability of the Clearinghouse.

Essential DOT Drug and Alcohol Screening

The Clearinghouse operates alongside the Department of Transportation’s (DOT) established drug and alcohol testing rules. Employers need a thorough testing program that covers various scenarios.

  • Pre-Employment: A driver must pass a drug test with a negative result before performing any safety-sensitive duties.
  • Post-Accident: Testing is mandatory after specific types of accidents, such as one involving a fatality or one where the driver receives a citation and a vehicle is towed or medical attention is required.
  • Random: Employers must perform unannounced, random tests on a percentage of their drivers annually, based on rates set by the FMCSA.
  • Reasonable Suspicion: If a properly trained supervisor notices behavior or appearance suggesting drug or alcohol use, they must order a test.
  • Return-to-Duty: Following a violation, a driver must test negative on a return-to-duty test before resuming safety-sensitive work.
  • Follow-Up: After a negative return-to-duty test, the driver must undergo at least six unannounced follow-up tests within the first year.
