The FMCSA Drug and Alcohol Clearinghouse is a secure, federally mandated online database that tracks drug and alcohol program violations for commercial driver’s license (CDL) holders. Launched in January 2020, the Clearinghouse was designed to close a critical gap in the system: the ability for drivers with violations to simply move from one employer to another without disclosure.
Here’s how it works in practice. When a CDL driver fails a DOT drug test—including testing positive for marijuana—the violation is reported to the Clearinghouse by the employer, Medical Review Officer (MRO), or Substance Abuse Professional (SAP). That record is then accessible to any prospective or current employer conducting a Clearinghouse query.
The database tracks:
- Positive drug test results (including marijuana)
- Alcohol test results above the federal threshold
- Refusals to test
- Return-to-duty (RTD) outcomes
- Follow-up testing completion records
For employers, the Clearinghouse is not optional—it’s a mandatory component of DOT drug testing compliance for all FMCSA-regulated carriers.
Compliance and Employer Responsibilities

Conduct Pre-Employment Queries
Before allowing a new CDL driver to operate a CMV, employers must run a full query in the Clearinghouse. A full query requires the driver’s electronic consent and reveals any unresolved drug or alcohol violations. If a violation is found, the driver cannot perform safety-sensitive functions until the return-to-duty process is complete.
For drivers who are already employed and whose records were queried within the past 12 months, a limited query (which does not require individual consent each time, but does require a blanket consent) may suffice.
Annual Queries for Current Employees
Employers must conduct at least one Clearinghouse query per CDL driver per year. This is an ongoing compliance requirement—not a one-time step. Building this into your annual HR calendar is a smart way to ensure nothing falls through the cracks.
Report Violations Promptly
When a driver tests positive on a DOT drug test—including for marijuana—the employer (or their designated service agent) must report the violation to the Clearinghouse within three business days. Delays in reporting can result in significant penalties and put other employers at risk of unknowingly hiring a driver with an unresolved violation.
