It is very important that regulated drug test are done on a regulated drug test form.  If not, it may not count as a valid test.
  • Non Regulated Drug Test: Non Regulated Drug tests are not mandated by government agencies and can be customized to meet the specific needs of the employer. They are commonly used in private-sector employment. It is very important that non regulated tests are done on non regulated drug test form or you may face penalties from the DOT.

What is a Non DOT Drug Test?

A non DOT drug test is a type of non-regulated drug test that does not follow the guidelines set by the Department of Transportation. Instead, it adheres to the employer’s specific requirements. Non DOT drug tests can screen for a variety of substances and are typically used in industries that do not fall under DOT regulations. Many states that offer drug free workplace discounts or have certain rules that mandate testing are non-dot.   Some examples:

Florida Drug Free Workplace, Ohio BWC Drug Testing, CAPUC Testing program or the California Public Utility Commission Program.

What is a 5 Panel Drug Test?

A 5 panel drug test is one of the most common types of drug tests used by employers. It screens for five categories of drugs:

  1. Marijuana
  2. Cocaine
  3. Amphetamines
  4. Opiates
  5. Phencyclidine (PCP)

What is a 10 Panel Drug Test?

A 10 panel drug test is more comprehensive than a 5 panel drug test. It screens for the same five drugs as the 5 panel test, plus five additional substances:

MROs or Medical Review Officer play a pivotal role in maintaining the accuracy and integrity of the drug testing process. Their responsibilities include verifying positive, negative, and inconclusive test results, identifying legitimate medical explanations for certain findings, and offering expert medical opinions during reviews. MRO or Medical Review Officer must possess specialized knowledge in substance abuse disorders, as well as the pharmacology and toxicology of both prescribed and illicit drugs. Additionally, they are required to stay current with regulations and guidelines to ensure adherence to relevant laws, such as those set by the Department of Transportation (DOT). Through their expertise and oversight, Medical Review Officers help uphold a fair and effective drug testing program that promotes workplace safety and health.

Medical Review Office are responsible for non-contact positives and the safety sensitive letter process.

FMCSA Clearinghouse

The FMCSA Clearinghouse is a digital database established by the Federal Motor Carrier Safety Administration (FMCSA) to track violations of drug and alcohol regulations among commercial drivers. Employers are mandated to report any violations, including failed tests, to the FMCSA Drug and Alcohol Clearinghouse. This system ensures that drivers who violate drug and alcohol regulations are identified and removed from safety-sensitive positions until they complete the necessary return-to-duty process. To comply with the FMCSA Drug and Alcohol Clearinghouse Mandate, employers must:

  1. Register with the FMCSA Drug and Alcohol Clearinghouse.
  2. Update their DOT Drug and Alcohol Testing policy to include a FMCSA Clearinghouse addendum.
  3. Educate supervisors and employees about their rights and responsibilities concerning the FMCSA Clearinghouse.
  4. Conduct pre-employment queries for every new hire in the FMCSA Clearinghouse.
  5. Perform annual queries for all drivers in the FMCSA Clearinghouse.
  6. Report all positive alcohol test results to the FMCSA Clearinghouse.
  7. Document and report all collection site refusals to the FMCSA Clearinghouse.
  8. Document and report any known drug and alcohol use to the FMCSA Clearinghouse.
  9. Report all return-to-duty tests to the FMCSA Clearinghouse.
  10. Report the completion of follow-up testing programs to the FMCSA Clearinghouse.
  11. Medical Review Officers (MROs) report all positive drug screens to the FMCSA Clearinghouse.

Physical Examinations
