HHS and DOJ pushed through rescheduling process.  Many in the industry, that are opponents of rescheduling, pushed back the process was unfair and rushed.  DEA appointed an Administrative Judge to hear both side of the  argument. One proponent of Marijuana Rescheduling, didn’t like one of the judges decisions and filed an appeal.  The administrative judge placed it on hold so the appeals court can make a determination.  NDASA’s  (National Drug and Alcohol Screening Association) has been accepted as a Expert Witness and will testify that the process and science are questionable.    Stay proactive by tracking updates on marijuana laws and adjusting your workplace policies accordingly.  Our CEO, Phil Dubois, is a Board Member of NDASA and Chairs the Government Affairs Committee of NDASA and is very active with Washington D.C.  fighting for the rights of employers to enjoy a Drug Free Workplace and working with a Safety Carve Out provision should Marijuana be rescheduled so all DOT employees will continue to be tested as they transport our children in school buses and  keep roads, airways and railways safe and drug free.

DOT is expected to roll out oral fluid testing soon, providing a less invasive yet effective alternative for drug screening. Although approved in 2023, the hold up is labs in the US must have validated and FDA Cleared assays before they test.  Two labs must be inspected and awarded SAMHSA Certification and additionally, collectors must be trained.
